Colorado DUI Penalties

Under Colorado DUI laws, motorists who operate a vehicle with a blood alcohol concentration (BAC) of .08% or higher can be charged with a DUI. This is a misdemeanor offense that can result in serious consequences. There are three types of impaired driving in the state of Colorado.

  • DUI: if an individual is under the influence of alcohol or drugs and found with a BAC of 0.08% while operating a vehicle
  • DWAI: if an individual in found with a BAC between 0.05% and 0.08% they will be considered “ability impaired,” a slight impairment
  • DUI per se: if an individual is found in a vehicle without even driving and in “physical control”

First-Offense DUI in Colorado

The penalties for a first-time DUI include:

  • Between 5 days and 1 year in jail
  • Fines of $600 up to $1,000
  • 9-month license suspension
  • Installation of ignition interlock device (IID) for 8 months
  • Up to 96 hours of community service
  • Mandatory alcohol education classes

Second-Offense DUI in Colorado

The penalties in Colorado for a second-offense DUI include:

  • Between 10 days and 1 year in jail
  • Fines of $600 up to $1,500
  • 1-year license suspension (if second DUI conviction is within 5 years)
  • Installation of ignition interlock device (IID) for 2 to 5 years
  • Up to 120 hours of community service
  • 2 years of probation
  • Mandatory alcohol education classes

Third-Offense DUI in Colorado

In Colorado, the penalties for a third-offense DUI include:

  • Between 60 days and 1 year in jail
  • Fines of $600 up to $1,500
  • Indefinite license revocation (apply for reinstatement after 2 years)
  • Installation of ignition interlock device (IID) for 2 to 5 years
  • Up to 120 hours of community service
  • 2 years of probation
  • Mandatory alcohol education classes

The 7-Day Rule

After a DUI arrest, law enforcement confiscates the motorist’s driver’s license and issues a temporary permit that is valid for seven days. The driver then has seven days to request a DMV hearing to fight to keep his or her license. Failing to do so will result in an automatic suspension.
